IMPORTANT — READ THIS AGREEMENT CAREFULLY
This is a legal contract between you and mySCADA s.r.o. By installing, copying, or using the software, you accept all terms. If you do not agree, do not install or use the software.
Disclaimer
The license agreement permits using one software copy on one computer. Each additional copy requires a separate license purchase.
Grant of License
Complying with this EULA's terms grants you a non-exclusive license to install and use the software on a single computer, network server, or multiple computers you own or lease — provided installations and users do not exceed valid purchases.
Capacity-based licensing (users, units, assets, tags, screens) cannot be exceeded. Additional capacity requires purchase through mySCADA or authorized distributors.
This license prohibits application service provider use, sublicensing, rental, sale, lease, transfer, or commercial hosting.
Copying Restrictions
Unauthorized copying, reverse assembly, reverse engineering, decompilation, and creation of derivative works are prohibited. Archival backup copies are permitted; no other copies are allowed. Documentation cannot be copied.
Limited Warranty
The software is warranted for 30 days post-delivery to substantially conform to supplied documentation. Defective media replacement is free during warranty. Modification voids the warranty.
mySCADA makes no representation that operation will be uninterrupted, error-free, or meet your requirements. You assume complete responsibility for decisions based on software-obtained information.
The foregoing limited warranty replaces all other warranties. mySCADA disclaims all implied warranties including title, non-infringement, merchantability, and fitness for particular purpose.
Limitation of Remedies
Your exclusive remedies for warranty breach are: (1) software replacement failing warranty requirements (with proof of purchase), or (2) EULA termination with refund if replacement is unavailable.
Limitation of Liability
mySCADA and third-party licensors are not liable for special, incidental, indirect, punitive, or consequential damages (including profit loss, information disclosure, business interruption, lost savings, privacy loss, or pecuniary loss) arising from software use — even if advised of damage possibilities.
mySCADA's maximum cumulative liability across all claims, including direct damages and indemnification, shall not exceed the software cost.
Term and Termination
This EULA becomes effective upon software use and continues until terminated. You may terminate by destroying all software and documentation copies. Automatic termination occurs upon non-compliance. Subscription-licensed software terminates after subscription expiration.
Academic Use
Educational institution purchases permit teaching and research use only. Commercial use is prohibited for educational-licensed software.
Preproduction Releases
Preproduction releases ("beta") are unsuitable for production use and are provided "as is" without warranty.
Audit
mySCADA may audit your software compliance upon reasonable notice. Non-compliance audits require you to reimburse reasonable audit expenses.
Ownership
Copyright and intellectual property laws protect the software and documentation. mySCADA or its licensors own all title, copyright, and intellectual property rights. Licensing does not constitute waiver of copyright protections.
Miscellaneous
This EULA is the complete, exclusive agreement superseding all prior agreements. Only written instruments signed by authorized mySCADA representatives may modify it. The English version prevails in any conflict with other language versions.
